In Georgia, a Judge will determine Custody of a Child by determining what is in the Best Interest of the Child. Determining the Best Interest of the Child is a subjective test that may require input from Child Psychologists, Child Psychiatrists, Expert Witnesses and a Guardian Ad Litem (A Lawyer appointed by the Court to represent the Best Interests of the Child), all of which will work to sway the Judge one way or the other.
